Terms of use

1. Who we are

BODYVERSE is provided by Redbridge Retail Ltd, a company registered in England and Wales under company number 17469279, whose registered office is at 19 Ruthin Gardens, Cardiff, CF24 4AU, United Kingdom ("we", "us" or "our"). You can contact us at hello@bodyvers.click.

These terms apply to the BODYVERSE mobile app, the BODYVERSE website and any related services (together, the "Service").

2. Accepting these terms

By creating an account or using the Service, you agree to these terms. Our medical disclaimer forms part of them, and our privacy policy explains how we handle personal data. If you do not agree, please do not use the Service.

If you use BODYVERSE through a school, college, university or other institution under an Education licence, the institution's agreement with us also applies. If that agreement conflicts with these terms, the agreement takes priority for that institution's users.

3. Who can use BODYVERSE

BODYVERSE is rated 16+. You may create your own account only if you are at least 16 years old. If you are under the age of majority where you live, you need the permission of a parent or guardian to make purchases.

Users under 16 may use BODYVERSE only through an institution that holds an Education licence, in kids mode, which restricts data collection. The institution is responsible for supervising that use and for obtaining any consent the law requires, for example from parents or guardians.

4. What BODYVERSE is, and what it is not

BODYVERSE is educational entertainment: a 3D game about the human body with interactive anatomy, missions, character progression and collectible bio-cards.

It is not a medical product. It is not a medical device, it does not diagnose, treat or prevent any condition, and it does not replace a doctor or other qualified professional. Character stats and Body Lab results are game mechanics, not measurements of your body. Do not rely on the Service for decisions about your health. Our medical disclaimer explains this in more detail.

5. Your account

• Give accurate information when you sign up, and keep it up to date.
• Keep your sign-in details secure and do not share your account. You are responsible for activity under your account.
• If you sign in through a third-party provider, that provider's terms also apply to how you sign in.
• Tell us straight away at hello@bodyvers.click if you think someone else has used your account.
• You can stop using the Service and ask us to delete your account at any time.

6. Acceptable use

When using the Service, you must not:

• break the law or infringe anyone else's rights;
• choose a display name, or share content, that is offensive or misleading, or that impersonates someone else;
• cheat, exploit bugs, or use bots, scripts or other tools to manipulate scores, streaks or leaderboards;
• interfere with or overload the Service, or try to gain unauthorised access to it, to our systems or to other users' accounts;
• copy, modify, sell or redistribute the app, its code or our original content, or reverse-engineer the app, except where the law or an applicable open licence allows it.

If you break these rules, we may remove content, reset scores or suspend your account (see section 14).

7. Subscriptions and in-app purchases

The Starter version is free. Premium subscriptions and other in-app purchases are sold through the Apple App Store and Google Play:

• Billing. The store takes payment at the price it shows when you buy.
• Renewal. Subscriptions renew automatically at the end of each billing period until you cancel.
• Cancellation. Cancel in your app store account settings before the renewal date to avoid the next charge; the store's rules set the exact deadline. You keep Premium until the end of the period you have paid for. Deleting the app or your BODYVERSE account does not cancel a subscription.
• Refunds. Refunds are handled by Apple or Google under their own refund policies. We cannot issue refunds for store purchases ourselves.
• Price changes. If a subscription price changes, the store will tell you in advance, as its rules require.

These terms are between you and us, not Apple or Google. The stores are not responsible for the Service or its support, but their own terms apply to your purchases.

The Education licence is sold directly to institutions under a separate agreement, with contracts and invoices.

8. Virtual items

The Service includes virtual items such as titles, skins, effects, bio-cards, experience points and levels. When you unlock or buy one, you receive a limited, personal, non-transferable licence to use it within the Service. Virtual items:

• have no monetary value and cannot be exchanged for money;
• cannot be sold or transferred to anyone else;
• exist only within the Service.

We may change, rebalance or retire virtual items as the game develops. If this affects an item you paid for, we will act fairly and in line with the law.

9. Content you share

BODYVERSE lets you save screenshots and short videos of your 3D body. You may share them, including on social media. If you want to use them commercially, for example in advertising, please ask us first. Sharing does not transfer any of our rights in the game's visuals.

You are responsible for what you share. Do not include other people's personal data without their permission.

If you send content to us directly, for example feedback or a screenshot you would like us to feature, you give us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with BODYVERSE. We will credit you where practical, and you can ask us to stop using it in future at any time.

10. Intellectual property and third-party licences

The Service, including its software, design, characters, texts and renders and the BODYVERSE name and logo, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose under these terms.

The 3D anatomy is based on BodyParts3D, © The Database Center for Life Science (DBCLS), licensed under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). We have modified the original models: parts are grouped and simplified, some structures are added schematically and the external genitalia are replaced by a neutral surface. Attribution appears in the app and on the website. The original models are available from DBCLS, and nothing in these terms limits your rights under that licence.

Other components, such as fonts and open-source software, are used under their own licences.

11. Availability and changes to the Service

We work to keep BODYVERSE available and up to date, but we cannot promise that it will always be available or free of errors. We may add, change or remove features, missions and other content, and we may pause the Service for maintenance or updates. Seasons and events may run for a limited time.

If a change significantly reduces a feature you have paid for, we will tell you in advance where we reasonably can. If we decide to close the Service, we will give you reasonable notice.

12. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted or error-free, that its content is complete, or that it is suitable for any particular purpose. The anatomy is simplified and some structures are schematic, as explained in the medical disclaimer.

Nothing in these terms affects your statutory rights as a consumer.

13. Limitation of liability

To the extent permitted by law:

• we are not liable for losses that were not reasonably foreseeable, or for indirect or consequential losses, such as loss of profit, business or opportunity;
• our total liability to you for all claims relating to the Service is limited to the amount you paid for it in the 12 months before the claim arose.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.

14. Suspension and termination

You can stop using BODYVERSE at any time and ask us to delete your account. Remember to cancel any subscription in your app store account as well.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires us to, or if we close the Service. Where appropriate, we will tell you why and give you a chance to respond.

When an account is closed, its progress and virtual items are deleted and cannot be restored. Sections 10, 12, 13 and 16 continue to apply after your account is closed.

15. Changes to these terms

We may update these terms, for example when we add features or when the law changes. We will publish the new version on this page with a new date and, for significant changes, tell you in the app or by email before they take effect. If you keep using the Service after that, the new terms apply. If you do not agree, you can stop using the Service and cancel your subscription.

16. Governing law and disputes

These terms are governed by the laws of England and Wales, and disputes will be decided by the courts of England and Wales. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may also bring a claim in its courts: for example, if you live in Scotland or Northern Ireland, you can bring a claim in the Scottish or Northern Irish courts. Before going to court, please contact us: most problems can be solved quickly.
